From third-parties that interact with us in connection with the services we perform. We may work with third-parties such as Facebook or Google in order to understand, customise, provide, support and market the services we provide and/or to comply with laws.
The technologies we use for automatic data collection may include:
Cookies (or browser cookies). A cookie is a small file placed on the hard drive of your computer. You may refuse to accept browser cookies by activating the appropriate setting on your browser. However, if you select this setting, you may be unable to access certain parts of our Website. Unless you have adjusted your browser setting so that it will refuse cookies, our system will issue cookies when you direct your browser to our Website.
Web Beacons. Pages of our Website may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs) that permit Bink Entertainment, for example, to count users who have visited those pages and for other related website statistics.

To offer alternative dispute resolution services.
For any other purpose with your consent or as permitted by law.
We will not retain the categories of personal information and sensitive personal information longer than reasonably necessary to achieve these business purposes. We will retain your personal information for up to 12 months beyond any closure of your account, unless a longer retention period is required or permitted by law (e.g., AML/KYC records are retained for a minimum of 5 years; sweepstakes AMOE mail-in request records are retained for a minimum of 5 years for regulatory audit purposes).
Automated Processing and Artificial Intelligence
We use automated systems and may use artificial intelligence, machine learning, and similar technologies (collectively, "AI Tools") to process personal information for the purposes described in this Policy. These purposes may include operating, securing, and personalizing the Service; providing customer support; detecting, preventing, and investigating fraud, abuse, and prohibited activity; identity, age, and risk assessment; content moderation; analytics and product improvement; and delivering communications. AI Tools may also have been used in the design, development, testing, and operation of the Service, as further described in Section 25 (Artificial Intelligence) of our Terms and Conditions.
Where we engage in automated decision-making that produces legal or similarly significant effects concerning you, we provide the rights and safeguards required by applicable law. Where such a right applies to you, you may contact us at the address below to request information about the processing or to request human review of a decision. Our use of AI Tools and any output they generate is provided as described in, and is subject to, the disclaimers of warranties and the limitations of liability set out in our Terms and Conditions.
We endeavor to comply with applicable laws and regulations governing automated processing, artificial intelligence, and the disclosure and transparency of automated or AI-assisted interactions. Nothing in this Section constitutes a representation that any particular statute or framework applies to you or to the Service.
Choices About How We Use and Disclose Your Information
Tracking Technologies and Advertising. You can set your browser to refuse all or some browser cookies, or to alert you when cookies are being sent. If you disable or refuse cookies, please note that some parts of this site may then be inaccessible or not function properly.
Promotional Offers. If you do not wish to have your contact information used by Bink Entertainment LLC to promote our own or third parties' products or services, you can opt-out at any time by sending us an email at . If we have sent you a promotional email, you may send us a return email asking to be omitted from future email distributions. This opt-out does not apply to information provided as a result of a product purchase or other transactions.
We do not control third parties' collection or use of your information to serve interest-based advertising. However, these third parties may provide you with ways to choose not to have your information collected or used in this way. You can opt out of receiving targeted ads from members of the Network Advertising Initiative ("NAI") on the NAI's website.
Calls, Text Messages, and Marketing Communications
When you provide a phone number, email address, or mailing address, we use that contact information to communicate with you by telephone call, text message (SMS/MMS), email, push notification, and mail. These communications include both (i) transactional and servicing messages relating to your account, purchases, redemptions, prizes, security, and these policies, and (ii) marketing and promotional messages about our products, services, offers, and the products and services of our partners.
By providing your phone number and accepting our Terms and Conditions, you give your prior express written consent to receive calls and text messages from us and from third parties acting on our behalf, including messages and calls made or sent using an automatic telephone dialing system or an artificial, prerecorded, or synthetic (including AI-generated) voice or message, for the purposes described above. The full terms of this consent — including that consent to marketing calls and texts is not a condition of purchase, and your right to revoke consent — are set out in Section 24 of our Terms and Conditions.
Text messages. Message frequency varies, and message and data rates may apply. You can stop receiving text messages at any time by replying STOP to any message from us, and you can reply HELP for help. Opting out of text messages may not stop calls, emails, or transactional and servicing messages.
Email. You can opt out of marketing emails at any time by using the "unsubscribe" link in any marketing email or by emailing us at . We may still send you non-marketing, transactional, and servicing emails relating to your account.
Telephone calls. You can ask us to stop making marketing or telemarketing calls to your number by contacting us at . We will continue to make calls necessary to service your account or as otherwise permitted by law.
We may share your contact information with service providers — such as email, telephony, and SMS messaging platforms — that send these communications on our behalf and are contractually bound to keep your information confidential and to use it only to provide services to us. Opting out of marketing communications does not affect our ability to contact you for transactional, servicing, security, legal, or regulatory purposes. This Section is in addition to the "Promotional Offers" choices described above and the consent terms in our Terms and Conditions.
Exercising Access, Correction, and Deletion Rights
You can review and change your personal information by logging into the Website and visiting your account profile page.
To request access to, correction of, or deletion of your personal information, you may also submit a verifiable consumer request to us at .
For your consumer request to be verifiable, you must provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information. You will need to provide your full name, date of birth, address, and email address. You must also describe your request with sufficient detail that allows us to properly understand, evaluate and respond to it.
We cannot delete your personal information except by also deleting your user account. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement, or cause the information to be incorrect. We cannot respond to your request if we cannot verify your identity or authority to make the request.
Response Timing and Format
We endeavor to provide timely responses to verifiable consumer requests. If you have an account with us, we will deliver our written response to that account. If you do not have an account with us, we will deliver our written response by mail or electronically, at your option. Any disclosures we provide will only cover the 12-month period preceding the verifiable consumer request's receipt.
The response we provide will also explain the reasons we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your personal information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance.
We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded.
Your State Privacy Rights
State consumer privacy laws may provide their residents with additional rights regarding our use of their personal information. California's "Shine the Light" law (Civil Code Section § 1798.83) permits users of our Website that are California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes. Note that we do NOT share personal information with third parties (that are not members of the Bink group) for this purpose.
Note that California is an Excluded Territory for this Platform and California residents are not eligible to participate in the Sweepstakes Promotion or redeem Bink Cash. Residents of other states with comprehensive privacy laws (Texas, Virginia, Colorado, Connecticut, etc.) may have rights to access, correct, delete, or opt out of the sale of their personal information. To exercise these rights, contact us at .
Data Security
We have implemented measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration, and disclosure. These include TLS 1.3 encryption for data in transit and AES-256 encryption for data at rest.
The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of our Website, you are responsible for keeping this password confidential. We ask you not to share your password with anyone.
In the event of a data breach that poses a risk to your rights and freedoms, we will notify relevant regulatory authorities without undue delay and, where feasible, within 72 hours of becoming aware of the breach. Where the breach is likely to result in a high risk to you, we will notify you directly as soon as reasonably practicable.
Unfortunately, the transmission of information via the internet is not completely secure. Although we do our best to protect your personal information, we cannot guarantee the security of your personal information transmitted to our Website. Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on the Website.
Non-Discrimination
We will not discriminate against you for exercising any of your rights described above. We will not deny you goods or services, charge you different prices or rates, provide you a different level or quality of goods or services, or suggest that you may receive a different price or rate for goods or services as a result of exercising your rights.
